These terms cover the Sensa Control system, which is sold as Sensa Nomad for vehicles and Sensa Helm for boats. They cover both the software licence and the optional annual Support Plan, because both are part of owning a Sensa system. Buying the kit from our shop is covered separately by our Terms of Sale; Radar has its own terms. How we handle your personal data is covered by our Privacy Policy, which forms part of this agreement.
The short version
This summary is here so you know what you are agreeing to. It is not part of the agreement and the numbered clauses below are what count.
- Your licence is perpetual. You buy it once. It does not expire, there is no subscription to use your own vehicle, and it keeps working with no internet connection at all.
- It is tied to one system. The licence binds to your hardware the first time it activates. If that hardware dies you can move the licence yourself, up to five times in any 30 days.
- Sensa Control is an aid, not a safety system. It switches heating, power, water and lighting. It is not a fire alarm, a gas detector, a carbon monoxide alarm, a bilge alarm or a substitute for any of them. Fit the proper safety equipment and do not rely on us for it.
- A trial licence lasts 14 days and then the system drops into read-only, where you can still see everything but can no longer switch anything.
- The Support Plan is the optional annual plan covering the five things that cannot run inside your vehicle. The first year comes with your system.
- Letting the Support Plan lapse is not the same as your licence expiring. Your van carries on exactly as before. Only the parts that run on our side stop.
- We do not try to escape responsibility for anything the law says we cannot escape, including death or personal injury caused by our negligence. What we do limit is set out in clause 25.

1. Who we are, and how to contact us
1.1 Sensa Control is supplied by Sensa Systems Ltd, a company registered in England and Wales under company number 16958196. Our registered office is 167-169 Great Portland Street, London, W1W 5PF and our VAT number is GB513010854. In these terms, “we”, “us” and “our” mean Sensa Systems Ltd, and “you” means the person or business holding the licence.
1.2 You can contact us at [email protected] or on 0330 223 7715. If we need to contact you, we will use the email address you gave us when you registered the system.
1.3 In these terms:
- “the Software” means the Sensa Control system: the Sensa App, the Sensa Nomad and Sensa Helm integrations, the Sensa Core library, the dashboards, the configuration it generates, and the documentation that goes with them.
- “your System” means the computer in your vehicle or vessel that the Software runs on, and that your licence is bound to.
- “your licence” means the digitally signed licence we issue you, which authorises the Software to run on your System.
- “edition” means the feature level your licence grants: Base, Pro, Vision or AI.
- “the Support Plan” means the Sensa Nomad Support Plan, the optional annual plan described in clauses 10 to 18.
2. These terms
2.1 These terms apply from the moment your licence is activated, whether you activated it yourself, it was activated for you by a dealer, or it was already installed on a system we supplied. If you do not accept these terms, do not use the Software, and contact us about returning the kit under the Terms of Sale.
2.2 You must be 18 or over to hold a Sensa Control licence.
2.3 We may change these terms. If the change is minor, such as a clarification or a correction, we will simply update this page and the date at the foot of it. If the change materially affects your rights, we will tell you by email at least 30 days before it takes effect, using the address registered against your system, and we will show it to you in your MySensa account. If you do not accept a material change, you may stop using the Software; because your licence is perpetual and already paid for, we will not refund it, but nothing obliges you to accept new terms in order to keep using the version you already have. Where a material change affects the Support Plan and you hold one, you may cancel it before the change takes effect and receive a refund of any part of the year you have paid for and not used.
2.4 If any clause of these terms turns out to be unenforceable, the rest of them continue to apply.
3. What Sensa Control is, and what it is not
3.1 Sensa Control brings the systems in a vehicle or vessel together into one interface: heating, power, lighting, water, security and the rest. It runs on a computer inside the vehicle rather than in the cloud, which is why it keeps working with no signal.
3.2 Sensa Control is a convenience and monitoring system. It is not a safety system. This is the most important clause in this agreement and we would rather say it plainly than bury it:
- It is not life-safety equipment. Sensa Control is not a smoke alarm, a heat alarm, a carbon monoxide detector, a gas leak detector, a bilge alarm, a fire suppression system or a security alarm certified to any standard. Fit the proper, certified equipment for each of those and maintain it. Where Sensa Control displays a reading or raises an alert from a sensor you have fitted, that is a convenience on top of the real equipment and never a replacement for it.
- Alerts can fail to arrive. An alert depends on a sensor working, on the system running, on power being present, and often on a network connection that a vehicle frequently does not have. Never design anything around Sensa Control telling you that something is wrong. Absence of an alert is not evidence that all is well.
- Automations act on their own. Scenes, instincts and routines switch real loads, including heating and pumps. You choose which to enable and you are responsible for the consequences of what you enable. Do not enable an automation that would be unsafe if it ran at the wrong moment.
- The physical installation is yours. Sensa Nomad is sold as a self-install kit and installation is not included. The wiring, the fusing, the cable sizing, the isolation and the compliance of the electrical and gas systems in your vehicle are your responsibility, or your installer’s. Vehicle electrical work can cause fire and injury if it is done wrongly. If you are not sure, use a qualified auto-electrician or marine electrician.
3.3 Sensa Control is built on Home Assistant, which is open-source software we did not write and do not control. Clause 21 covers the open-source components. A change to Home Assistant, or to any device manufacturer’s own integration, can change or break behaviour we did not choose and cannot always prevent.
3.4 Devices are made by other people. Sensa Control talks to hardware from many manufacturers. Which devices work, and how well, depends on those manufacturers’ own firmware and interfaces, which they change without telling us. The current list is published on our site and in the documentation, and it changes. A device working today is not a promise that its manufacturer will keep it working.
4. Your licence
4.1 What we grant you. Subject to these terms, we grant you a perpetual, non-exclusive, non-transferable licence to install and use the Software on your System, using the features your edition permits, for as long as you wish.
4.2 Perpetual means perpetual. There is no subscription and no recurring fee for controlling your own vehicle. Once activated, your licence is validated entirely offline by your System: it does not need our servers, an internet connection, or our continued existence as a company in order to keep running the vehicle it is installed in.
4.3 What perpetual does not mean. It does not mean every part of the service is perpetual. The things that run on our side, listed in clause 10, depend on the Support Plan. It does not mean we will support every version forever, and it does not stop us withdrawing a licence in the narrow circumstances in clause 24.
4.4 One licence, one system. A licence covers one System at a time. It also allows a second activation for a development or test system, so you can try something without taking your vehicle offline. It does not entitle you to run two vehicles from one licence.
4.5 Trial licences are different. A trial is time-limited, and clause 8 sets out how it works.
5. Activation, and the system your licence is tied to
5.1 Activation happens once, online. You enter your registration code and your System sends it to us with a hardware fingerprint: a value derived from your hardware’s network address, its board serial number and the Home Assistant installation identifier, combined and hashed. We bind the licence to that fingerprint and issue a signed licence that names it.
5.2 After that it works offline, indefinitely. Your System checks the signature and the fingerprint itself. It does not need to reach us again to keep running.
5.3 The check is lenient by design. If the fingerprint stops matching, for example because you changed a network card, the System flags that the hardware has changed and asks you to register again. It does not stop working and it does not lock you out. We built it this way because connectivity in a vehicle is unreliable and a licence check that bricks a van on a hunch is worse than the problem it solves.
5.4 We check for conflicts on our side. If the same licence appears on two systems, we will see it the next time either one contacts us, and clause 24.2 applies.
5.5 Systems we supply arrive activated. If you bought a complete Sensa system rather than software alone, we activate it during manufacture and you have nothing to enter.
6. Replacing or moving your hardware
6.1 You can do this yourself. If your hardware fails, or you upgrade it, install the Software on the new hardware and enter the same registration code. The licence moves to the new System and the old binding is released. You do not need to contact us and there is no charge.
6.2 Fair-use limit. You can move a licence five times in any 30-day period. Beyond that the move is refused until the 30 days have passed. The limit exists to catch a licence being shared across several vehicles, not to inconvenience someone with a failing SD card. If you have a genuine reason to exceed it, email us and we will reset it.
6.3 Moving to a different vehicle is fine. The licence is yours, not the vehicle’s.
6.4 Selling your vehicle. You may transfer your licence with the vehicle if you sell it, provided you tell us so we can move the registration to the new owner, and provided you keep no copy of the Software yourself. This is the one exception to the non-transferability in clause 4.1. If you sell the vehicle and keep the licence for another van, that is also fine, but you may not do both.
6.5 A restored backup carries your configuration, not a second licence. Restoring a backup onto replacement hardware is the normal recovery route and is covered by clause 6.1.
7. Editions, device limits and which devices you can add
7.1 Your edition is Base, Pro, Vision or AI, and it determines which features you have and how many devices you can add.
7.2 Device limits. Unless your licence says otherwise, the number of devices you can have registered at once is:

A device that is disabled or ignored does not count. Reaching the limit stops you adding a new device; it never removes one you already have, and you can always change or re-add an existing device.
7.3 Some devices need a higher edition. A small number of devices are reserved to higher editions. Where that applies, the device still appears in your device list, marked as needing an upgrade, rather than being hidden from you. We would rather tell you a device exists and is not included than pretend we cannot see it.
7.4 We may change which devices sit in which edition, usually by adding new ones. We will not move a device you have already added into a higher edition, and a device you are already using keeps working.
7.5 Upgrading. You can upgrade your edition at any time by buying an upgrade from us. Your limits change when the new licence reaches your System.
8. Trials
8.1 A trial gives you the full system for 14 days, with no payment and no card details. It is provisioned automatically when you install without a registration code.
8.2 One trial per piece of hardware. If a system has already had its trial, installing again will not start another. The System will tell you so and point you at the shop.
8.3 When a trial ends, the System drops into read-only as described in clause 9. Nothing is deleted. Everything you configured is still there, and buying a licence and entering the code restores full control immediately.
8.4 A trial is supplied free of charge. Clause 25.6 explains what that means for our responsibility to you.
9. Read-only: what happens if a licence ends
9.1 When it applies. A System drops into read-only when a trial expires, when a time-limited licence reaches its expiry date and is not renewed, or when a licence is revoked or deleted under clause 24. A perpetual licence in good standing never enters read-only, and neither does a lapsed Support Plan, which clause 18 covers.
9.2 What read-only means. You can still see everything: every dashboard, every reading, every sensor, the full history. What you cannot do is switch anything from the Sensa interface. Lights, relays, heating, modes and scenes cannot be actuated from the Sensa screens.
9.3 What read-only never blocks. These stay available, deliberately, because they are how you recover:
- viewing all of your data;
- configuration and settings;
- entering a licence code and re-registering;
- taking, downloading and restoring backups;
- safety alarms and notifications.
9.4 Read-only is a Sensa restriction, not a vehicle one. It applies to the Sensa interface. It does not disable your vehicle, its electrics, its heating or any physical control. Every manual switch, isolator and manufacturer’s own control in the vehicle continues to work exactly as it did. We restrict our software; we do not immobilise anything.
9.5 It is reversible and nothing is lost. Entering a valid licence code restores control immediately. We do not delete your configuration, your history or your backups because a licence lapsed.
10. What the Support Plan is
10.1 The Support Plan is an optional annual service, not a licence. The annual plan that keeps the Sensa-managed side of a Nomad running: remote access to your own system, remote support from Sensa, cloud backups, the Nomad software updates we deliver, and Radar Premium.
10.2 It is optional, and it is not needed to use your vehicle. Everything that controls the van runs on the computer inside it. The plan covers the five things whose whole purpose is that they come from outside the vehicle, and they are set out in clauses 11 to 15.
10.3 The plan covers one System. If you have more than one, each needs its own plan.
10.4 The plan is priced by the edition of the system it looks after, because a larger system has more of ours running behind it. Current prices are published on the Support Plan page.
11. Remote access for you
11.1 We provide a secure route to reach your own System from outside the vehicle, so you do not need a static IP address or to configure your router.
11.2 It depends on the vehicle having a working internet connection. In a vehicle that is frequently the weakest part, and we cannot be responsible for a connection we do not supply.
11.3 We do not guarantee uninterrupted availability. Remote access relies on third-party network infrastructure, and clause 25.8 applies.
12. Remote support from Sensa
Please read this clause. It is the one that grants us access to your system.
12.1 What it allows. Our staff can sign in to your System to diagnose and fix a problem, rather than talking you through it.
12.2 You control it, and it is off unless you turn it on. Access requires the remote support consent switch on your System to be enabled. You can turn it off at any point, including during a session, and doing so ends our access.
12.3 Sessions are time-limited and logged. Every session expires on its own, and every session is recorded so that you can see what happened and when.
12.4 The one exception, stated plainly. Where your System is broken badly enough that you cannot reach the consent switch yourself, we can open a session from our side. We do this only to restore a system you have asked us to help with, it is subject to the same time limit, and it is logged in the same way. We will tell you when we have used it. We will not use it to access a system on a whim, for any commercial purpose, or without a support request from you, except where we need to act on a safety issue affecting your System.
12.5 What we will not do. We do not use remote access to read your personal data for any purpose other than fixing the problem you reported, and we do not use it to enforce these terms or your licence.
12.6 Support is best-effort. We aim to respond promptly and we do not commit to a fixed response time, a fixed resolution time, or any availability guarantee. We do not provide support for third-party devices we did not supply, for your vehicle’s wiring or installation, or for a Home Assistant installation you manage yourself beyond the Sensa parts of it.
13. Cloud backups
13.1 Your System’s configuration is copied off the vehicle automatically, so that a failed storage card or a stolen vehicle means a restore rather than a rebuild.
13.2 What is backed up is your configuration, which is the part that took the longest to get right. It is not a backup of your vehicle’s hardware, and restoring it onto replacement hardware still requires you to have that hardware.
13.3 Backups are encrypted. We hold the encryption key so that we can help you restore a system when you no longer have the key yourself, which is the situation a backup exists for. Because we hold the key, our backups are not end-to-end encrypted and we do not describe them as such. How we protect and access it is set out in the Privacy Policy.
13.4 Keep your own copy too. We take reasonable care, but no backup service is a guarantee, and we recommend you also keep a copy you control. Subject to clause 25.1, we are not responsible for a backup that turns out to be unusable.
13.5 When the plan ends, we stop taking new copies. Clause 18.3 covers what happens to the copies we already hold.
14. Software updates
14.1 Where you hold a Support Plan, we deliver Sensa software updates to your System and apply them for you.
14.2 You choose the maintenance window, so that updates land when you are not using the vehicle. Operating system updates are applied in the same window rather than separately.
14.3 We test first. Every release runs on our own vehicles before it reaches yours. That is a description of our process and not a warranty that a release will be free of faults.
14.4 We take a snapshot before we apply an update, so that a failed update can be rolled back.
14.5 We are not obliged to produce updates, and no update is promised on any timetable. The plan covers delivering and applying updates we publish, not a commitment to publish any particular one.
14.6 Where you run your own Home Assistant rather than a system we supplied, you update the Sensa add-on yourself through Home Assistant, in your own time, and clauses 14.1 to 14.4 do not apply to you.
14.7 Updates can change things. An update may add, alter or remove a feature, including because a device manufacturer or Home Assistant changed something underneath us. We will not deliberately remove a feature that is central to the edition you bought without telling you first under clause 2.3.
15. Radar Premium licences
15.1 The Support Plan includes Radar Premium licences: one with Base, and two with Pro, Vision and AI, for the people in your household.
15.2 Each licence covers one person. Radar Premium is governed by the Sensa Radar Terms, and clause 5.3 of those terms explains how a licence reaching you this way differs from one you buy directly.
15.3 They last as long as the plan does. If the plan lapses, those licences drop back to Radar Free, which keeps working.
16. Price, the first year, and renewal
16.1 The first year of the Support Plan is included in the price of every Nomad system. The first year is included in the price of every Nomad system. After that it renews annually, and renewing is optional.
16.2 Prices are published on the Support Plan page, in GBP and including VAT.
16.3 Renewal. Towards the end of each year we will invite you to renew. We will tell you before your plan is due to end, so that a lapse is never a surprise.
16.4 Where you have set up a recurring payment, the plan renews automatically at the then-current price until you cancel, and we will tell you the amount and the date in advance.
16.5 Price changes. We may change the price of the plan. We will tell you at least 30 days before a change affects you, and you may decline to renew.
16.6 Renewing after a lapse. You can renew at any time, including after the plan has lapsed, and all five services come back. We do not charge a reconnection fee and we do not ask you to pay for the period you were not covered.
17. Cancelling the plan
17.1 You can cancel at any time, in your MySensa account or by emailing us.
17.2 Cancellation takes effect at the end of the period you have already paid for, and the plan continues until then.
17.3 Your 14-day right. If you are a consumer, you have a legal right to change your mind within 14 days of taking out or renewing a plan and to receive a refund. If you asked us to start the plan immediately, we may deduct a proportionate amount for the part of the period you have already had. This right applies to a new plan and to a renewal you paid for, and it is in addition to clause 17.2.
17.4 Simply not renewing is enough. You do not have to tell us anything to let a plan lapse.
17.5 Cancelling the plan does not affect your licence. Your perpetual licence is unaffected, and clause 18 sets out exactly what changes.
18. If the plan lapses
18.1 Your vehicle keeps working. A Nomad whose plan has lapsed carries on controlling the vehicle exactly as before, including scenes and instincts, because all of that runs on the computer in the van. What stops is the part that runs on our side. There is no licence fee to control your own van, and nothing switches off on the anniversary.
18.2 Exactly five things stop:
- Remote access for you. You can still control the System from inside the vehicle and on its own network; you stop being able to reach it from elsewhere.
- Remote support from us. We can no longer sign in to fix something for you.
- Cloud backups. Your configuration stops being copied off the vehicle.
- Software updates. Your System stays on the version it is running, which keeps working exactly as it does today. It simply stops being moved forward.
- The Radar Premium licences, which drop back to Radar Free.
18.3 Your existing backups. We keep the copies we already hold for a reasonable period after a plan lapses so that you can renew or ask for them, and we will not delete them without telling you first. The retention period is set out in the Privacy Policy. You can ask us for a copy, or ask us to delete them, at any time and free of charge.
18.4 Nothing else changes and nothing is deleted.
19. What we need from you
19.1 You are responsible for the vehicle or vessel, its installation and its safety, as clause 3.2 sets out.
19.2 You are responsible for keeping your Sensa account and your system’s logins secure, and for anything done through them. Tell us promptly at [email protected] if you think someone else has access.
19.3 You are responsible for your own backups where you run your own Home Assistant, and for checking that a backup you rely on actually restores. Where cloud backup is included through the Support Plan, we take care of the copy off the vehicle, but we still recommend you keep one of your own.
19.4 You must keep the registration details on your system accurate, so that we can reach you about a safety issue or a material change to these terms.
19.5 Keep your System reachable if you want the services that depend on a connection. A vehicle stored with no power or no signal will not receive updates or backups, and that is not a failure of the plan.
19.6 Tell us if you sell the vehicle or transfer the System, so that we can move the plan or stop it. We will not knowingly leave remote access enabled to a system you no longer own.
20. Acceptable use
20.1 You may use the Software to run your own vehicle or vessel, and, if you run a vehicle-related business, to run that business’s own vehicles.
20.2 You must not:
- copy or reproduce the Software, other than as your System needs to run it and for your own backups;
- sell, rent, lend, sublicense or otherwise pass on the Software or your licence, except in the vehicle sale case in clause 6.4;
- run one licence on more than one vehicle at a time;
- remove or obscure our notices or marks;
- interfere with, disable or attempt to work around the licence checking, the hardware binding or the edition limits;
- reverse engineer, decompile or disassemble the Software, except to the extent the law expressly permits, and except for the open-source components in clause 21, whose own licences govern what you may do with them;
- separate a component of the Software and use it on its own, outside a complete Sensa Control system;
- use the Software to do anything unlawful.
20.3 Security research. If you believe you have found a security vulnerability, please report it to [email protected] rather than testing it further. We will not pursue anyone who reports a genuine issue responsibly and privately.
21. Open-source components
21.1 The Software includes open-source components, including Home Assistant itself, each supplied under its own licence. Those licences are listed in the notices file included with the Software and published alongside it.
21.2 Nothing in these terms restricts your rights under those open-source licences in respect of those components. Where an open-source licence gives you a right that this agreement appears to take away, the open-source licence wins for that component.
21.3 Where a component is licensed under the GPL or a similar licence that entitles you to its source code, you may request it from us at [email protected] and we will supply it, or tell you where to obtain it, at no more than our reasonable cost of doing so.
22. Data, and the checks the system makes
22.1 What your System sends us, and what we do with it, is set out in full in our Privacy Policy. This clause is a summary and the Privacy Policy is what governs.
22.2 Registration. When you register, we collect your name and email address so that we can support you and reach you.
22.3 Licence check-ins. Your System contacts us periodically to confirm the licence is still valid and to collect anything we need to hand it, such as a version to update to. For a paid licence this is best-effort and never a gate: if it cannot reach us, it carries on working.
22.4 Basic system information. A check-in carries a small amount of information about the system itself, such as the software versions it is running, the kind of hardware it is on, and counts of how many devices and entities it has. We use it to know what is in the field and to support you.
22.5 Diagnostics are opt-in and off by default. More detailed diagnostic reporting, covering your device inventory, failing entities, recent errors and resource use, is controlled by five separate switches in your system’s settings. They are all off unless you turn them on, and you can turn them off again at any time.
22.6 Remote support is consented and logged, as clause 12 sets out.
22.7 Location. Where you enable features that use the vehicle’s position, such as tracking or the Schengen day counter, what is sent and to where is set out in the Privacy Policy. Turning the relevant feature off means no position data leaves your vehicle for it.
23. Availability, and changes
23.1 We aim to keep the Support Plan’s services available and to provide them with reasonable skill and care, but we do not promise that they will be uninterrupted or error-free. They depend on third-party infrastructure and on your vehicle’s own connection.
23.2 We may change what the plan includes. Where a change materially reduces what you are getting, clause 2.3 applies: we tell you 30 days beforehand and you may cancel and be refunded for the unused part.
23.3 We may suspend a service for maintenance, and will try to give notice where we can.
23.4 We may withdraw the Support Plan altogether. If we do, we will give at least 30 days’ notice, refund the unused part, and give you a reasonable period to retrieve your backups first. Your vehicle would continue to work, because clause 18.1 does not depend on us still being here.
24. Ending this agreement
24.1 You can stop using the Software at any time. Your perpetual licence does not need cancelling, and there is nothing to pay.
24.2 When we may revoke a licence. We may revoke a licence, which puts the System into read-only under clause 9, only where:
- the licence has not been paid for, or a payment has been reversed;
- the same licence is being run on more than one vehicle at a time, contrary to clause 4.4;
- you have seriously or repeatedly broken clause 20, in particular by circumventing the licence checking or redistributing the Software;
- we are required to by law.
24.3 We will tell you first where we can. Except where the law prevents it, or where a licence is plainly being abused, we will contact you, explain the problem and give you a fair chance to put it right before revoking anything. Revocation is a last resort, not a first response to a support question.
24.4 If we revoke a licence in error, or for a reason that turns out not to be your fault, we will restore it promptly. Clause 9.5 means nothing is lost in the meantime.
24.5 We may suspend or end a Support Plan if you do not pay, if you seriously or repeatedly misuse the services, or if we are required to by law. Where it is practical and lawful, we will tell you why and give you a chance to put it right first. If we end a plan for a reason that is not your fault, we will refund the unused part. Ending the plan does not affect your licence.
24.6 Clauses 13.3, 20, 21, 25, 26, 28 and 29 survive the end of this agreement.
25. Our responsibility for loss or damage
Please read this clause carefully.
25.1 We do not exclude, and nothing in these terms limits, our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- any liability that cannot be excluded or limited under the law that applies to you, including, if you are a UK consumer, your statutory rights under the Consumer Rights Act 2015 that goods and digital content be of satisfactory quality, fit for purpose and as described, and that a service be performed with reasonable care and skill;
- damage to your device or to your other digital content caused by our digital content, where the Consumer Rights Act 2015 makes us responsible for repairing it or compensating you.
25.2 If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. Loss or damage is foreseeable if it is obvious that it will happen, or if both you and we knew when you bought the licence that it might happen.
25.3 The installation and the vehicle. Subject to clause 25.1, we are not responsible for loss or damage caused by the way the system was installed in your vehicle or vessel, by the wiring, fusing, isolation or protection of that vehicle’s electrical or gas systems, or by any device made by someone else. Sensa Nomad is a self-install kit and clause 3.2 sets out where that responsibility sits.
25.4 Not a safety system. Subject to clause 25.1, and given what clause 3.2 says plainly, we are not responsible for loss or damage arising from a reliance on Sensa Control as safety equipment, from an alert that did not arrive, or from an absence of an alert being taken as an indication that nothing was wrong.
25.5 Backups. Subject to clause 25.1, and given clause 13.4, our responsibility for a backup that proves unusable is limited to taking reasonable care in making it. We are not responsible for a rebuild you have to do because you kept no copy of your own.
25.6 Trials. A trial licence is supplied free of charge. To the fullest extent the law allows, and subject always to clause 25.1, we accept no liability to trial users beyond the non-excludable matters listed in clause 25.1.
25.7 Business use. If you use the Software or the Support Plan for any commercial purpose, we exclude, to the fullest extent the law allows, all liability for loss of profit, loss of business, business interruption, loss of contracts, loss of anticipated savings, loss of goodwill, and any indirect or consequential loss.
25.8 Things outside our control. We are not responsible for failures caused by events outside our reasonable control, including failures of the internet, of a hosting or payment provider, of a mobile network, of a device manufacturer’s own service, of Home Assistant, or of your own equipment, power supply or connection.
25.9 Overall cap. Subject to clauses 25.1 and 25.7, our total liability to you for all claims connected with the Software and the Support Plan is limited to the greater of the amount you paid us for your licence and, if you hold one, your current Support Plan, or £100.
26. Our intellectual property
26.1 The Software, including its design, its branding and the way it presents and controls a vehicle, belongs to us or to our licensors, except for the open-source components covered by clause 21. Nothing in these terms transfers any of it to you.
26.2 You get the licence described in clause 4 and nothing more. All rights not expressly granted are reserved.
26.3 “Sensa”, “Sensa Nomad”, “Sensa Helm” and “Sensa Radar” are our marks. Do not use them without our written agreement, except to refer to us honestly.
26.4 What you configure is yours. Your dashboards, scenes, automations and settings are yours, and you can export them and take them with you.
27. Complaints
27.1 If something has gone wrong, email us at [email protected] and tell us what happened. We will acknowledge within five working days and try to resolve it within 30 days.
27.2 If you are a consumer and we cannot resolve it between us, nothing in these terms stops you taking the matter to court, or using an alternative dispute resolution service if one is available to you.
28. General
28.1 These terms, together with our Privacy Policy and, where they apply, the Terms of Sale, are the whole agreement between you and us about the Software and the Support Plan.
28.2 We may transfer our rights and obligations under these terms to another organisation, for example if the business is sold. We will tell you if this happens. Because your licence is perpetual and validated on your own hardware, a transfer of our business does not affect your ability to keep using it. If a transfer disadvantages you, you may cancel a Support Plan and be refunded the unused part.
28.3 This agreement is between you and us. Nobody else has any right to enforce it.
28.4 If we delay enforcing a term, or do not enforce it, that does not stop us doing so later.
28.5 If you bought through a dealer, your licence terms are these terms. Anything your dealer agreed with you separately, such as installation work, is between you and them.
29. Which law applies, and where you can bring a claim
29.1 These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales.
29.2 If you are a consumer living elsewhere in the United Kingdom, you may also bring proceedings in the courts of Scotland or Northern Ireland, as applicable.
29.3 If you are a consumer living outside the United Kingdom, clause 29.1 does not deprive you of the protection given to you by the mandatory consumer law of the country you live in, and you may bring proceedings in your local courts.
